1. Terms of Use
1.1 Acceptance of Terms
By accessing or using the Services, you agree to these Terms of Use (the "Terms"). If you do not agree, do not use the Services. If you are using the Services on behalf of an organization, you represent that you are authorized to bind that organization.
1.2 Eligibility
You must be at least 18 years old and capable of forming a binding contract. The Services are intended for use in the United States. If you access the Services from outside the United States, you do so at your own risk and are responsible for compliance with local laws.
1.3 Changes to the Terms
We may update these Terms at any time. Material changes will be posted and indicated by the "Last updated" date. Your continued use after changes become effective constitutes acceptance.
1.4 Account Registration & Security
You are responsible for your account, credentials, and all activity under it. Keep your password secure and notify us promptly of any unauthorized access. We may require identity verification and may suspend or terminate accounts for suspected misuse.
1.5 Subscriptions, Trials, and Payments
If the Services are provided on a paid or subscription basis: (a) fees, billing cycles, and renewal terms will be disclosed at checkout; (b) you authorize us and our payment processor to charge applicable amounts, including taxes; (c) unless stated otherwise, subscriptions renew automatically until cancelled; (d) except where required by law, fees are non-refundable; (e) we may modify pricing prospectively upon notice.
1.6 Use Restrictions (Acceptable Use)
You will not, and will not allow others to:
- Reverse engineer, decompile, or access the Services to build a competitive product
- Exceed usage limits, circumvent rate limits, or scrape or harvest data without permission
- Submit malicious code or interfere with security
- Use the Services to discriminate or violate fair housing or other laws
- Misrepresent outputs as certified appraisals, financial advice, or guaranteed returns
- Use outputs for unlawful solicitation or marketing
- Remove proprietary notices
- Copy, reproduce, distribute, publicly display, or create derivative works of the Services or any Company Content, except as expressly permitted in these Terms
- Use the Services or Company Content in any manner that infringes, misappropriates, or violates the Company's or any third party's intellectual property rights
1.7 Ownership; Licenses
We and our licensors own all rights, title, and interest in and to the Services and all content, models, algorithms, datasets, score methodologies, graphics, text, user interface elements, and other materials we provide (collectively, "Company Content"), including all associated intellectual property rights. The Services and Company Content are protected by United States and international copyright, trademark, and other intellectual property laws.
Except for the limited license expressly granted to you in these Terms, no rights are granted to you, whether by implication, estoppel, or otherwise. All rights not expressly granted are reserved.
You receive a limited, non-exclusive, non-transferable license to use the Services during your subscription solely for internal, lawful purposes. You retain ownership of data you upload ("User Content"), and you grant us a non-exclusive license to use User Content to provide and improve the Services, comply with law, and enforce these Terms. You grant us a perpetual, royalty-free license to use feedback and suggestions.
1.8 Third-Party Materials & Data Licenses
Services may display or rely on third-party data, including public records, market data, and partner datasets. Your use of third-party materials may be subject to additional terms. You agree to comply with all applicable data license restrictions. We may remove third-party materials at any time.
1.9 No Investment Advice — Informational Use Only
⚠️ Important Disclosure
Good Investment provides data, analytics, scores, forecasts, and other information for informational purposes only. Nothing on the site or in the app constitutes financial, investment, legal, or tax advice, or a recommendation to buy, sell, or hold any security or real property.
- We Are Not Investment Advisors. Good Investment, Inc. is not a registered investment advisor, broker-dealer, financial planner, or fiduciary. We do not provide personalized investment recommendations.
- Model Outputs, Not Recommendations. All scores, forecasts, expected returns, and assessments are generated by automated models based on historical and market data. They describe what our models indicate about properties — they do not tell you what to do.
- No Fiduciary Relationship. Your use of the Services does not create any fiduciary, advisory, or professional relationship between you and Good Investment. We provide tools and analytics, not advice.
- You Are Solely Responsible. You are solely responsible for your own investment decisions. You should consult appropriate professional advisors (financial, legal, tax, real estate) before making any investment decisions.
- No Guarantees. We make no guarantees of accuracy, completeness, or performance of any property, market, or model output. Past performance does not guarantee future results.
- Model Limitations. Our models are based on historical data and assumptions that may not hold in the future. Market conditions, property conditions, and other factors can change unpredictably.
1.9A Professional, Regulatory, and Fair Housing Disclaimers
Not an Appraisal or Broker-Dealer Service. We are not an appraiser, real estate broker, mortgage lender, or broker-dealer, and the Services are not a substitute for a comparative market analysis (CMA), appraisal, inspection, or underwriting.
Fair Housing. You agree not to use the Services to discriminate or "steer" based on protected characteristics. You remain solely responsible for compliance with the Fair Housing Act and state/local analogues.
1.10 Model Output, Scores, and Forecasts — Important Limitations
Our Services provide model-generated analytics, including year-over-year return estimates and a proprietary "Score." These outputs are:
- Probabilistic & Assumption-Dependent. Estimates rely on historical data, assumptions, and uncertain factors; they are not guarantees of future performance.
- Incomplete & Subject to Change. Datasets may be delayed, incomplete, or contain errors; outputs may change as data and models update.
- Decision Support Only. Outputs are decision-support tools, not definitive recommendations. You are responsible for your choices and outcomes.
1.10A Proprietary Models, Score, and Outputs
You acknowledge that our predictive models, algorithms, feature engineering, calibration techniques, and scoring methodology used to generate analytics, projections, and the proprietary "Score" (collectively, the "Models") are confidential and proprietary to the Company and constitute trade secrets and other intellectual property of the Company. You obtain no rights in or to the Models themselves.
Subject to these Terms and your active subscription, the Company grants you a limited, non-exclusive, non-transferable license to use the outputs generated by the Services (including scores, projections, and reports) solely for your internal business purposes in the ordinary course of advising your clients. You may not: (a) resell, sublicense, or distribute the outputs as a stand-alone data product or analytics service; (b) use the outputs to train or develop a competing model or service; or (c) systematically export or scrape outputs for purposes of building or improving a competing product.
1.11 No Warranties
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICES AND ALL OUTPUTS ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING ACCURACY, RELIABILITY, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR THAT THE SERVICES WILL BE ERROR-FREE OR UNINTERRUPTED.
1.12 Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, NEITHER WE NOR OUR AFFILIATES OR LICENSORS ARE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOSS OF DATA, OR BUSINESS INTERRUPTION, EVEN IF ADVISED OF THE POSSIBILITY. OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICES WILL NOT EXCEED THE AMOUNTS YOU PAID TO US FOR THE SERVICES IN THE TWELVE (12) MONTHS PRIOR TO THE EVENT GIVING RISE TO THE CLAIM, OR $1,000, WHICHEVER IS GREATER.
1.13 Indemnification
You will defend, indemnify, and hold harmless the Company from any claims, damages, liabilities, and expenses arising from your use of the Services, User Content, or violation of these Terms or law.
1.14 Suspension & Termination
We may suspend or terminate your access for any reason, including suspected misuse or non-payment. Upon termination, your license ends and you must stop using the Services. Sections intended to survive (e.g., ownership, disclaimers, limits of liability, dispute resolution) will survive.
1.15 Governing Law; Venue
These Terms are governed by the laws of the District of Columbia, without regard to conflict-of-laws principles. Courts located in Washington, D.C. have exclusive jurisdiction for disputes not subject to arbitration.
1.16 Copyright Complaints (DMCA)
We respect the intellectual property rights of others and expect our users to do the same. If you believe that any content on the Services infringes your copyright, you may submit a notice to our designated agent at support@marbary.com with the following information:
- A description of the copyrighted work you claim has been infringed
- A description of the allegedly infringing material and its location on the Services
- Your contact information (name, address, telephone number, and email address)
- A statement that you have a good-faith belief that use of the material is not authorized by the copyright owner, its agent, or the law
- A statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on the owner's behalf
- Your physical or electronic signature
The Company may remove or disable access to any content alleged to be infringing and may terminate repeat infringers' accounts in appropriate circumstances.
